These Terms and Conditions (“Terms”) govern your access to and use of the NearU app (“App”), a product developed by WEB WORLD, with a registered office at Worli, Mumbai. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
Please read these Terms carefully before using the NearU App.
1. Acceptance of Terms
By accessing or using the NearU App, you agree to comply with these Terms and Conditions, as well as any other policies or guidelines incorporated by reference. If you are using the App on behalf of an organization or entity, you represent and warrant that you have the authority to bind such organization or entity to these Terms.
WEB WORLD (“we,” “us,” “our”) reserves the right to modify or update these Terms at any time. Changes will be posted on this page, and the “Effective Date” will be updated accordingly. Your continued use of the App after any changes to these Terms constitutes your acceptance of the modified Terms.
2. Use of the App
a) Eligibility
To use the NearU App, you must be at least 16 years old. By using the App, you represent and warrant that you meet this age requirement. If you are under 16, you may not use the App without the consent of a parent or guardian.
b) License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use the NearU App on your mobile device for personal, non-commercial use.
c) Prohibited Activities
You agree not to:
- Violate any applicable local, state, national, or international law while using the App.
- Engage in any activity that interferes with or disrupts the functionality of the App or our servers.
- Attempt to gain unauthorized access to the App, user accounts, or any associated networks or systems.
- Use the App to distribute viruses, malware, or any other harmful code.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use the App to transmit, distribute, or store content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
d) Account Responsibility
You may be required to create an account to use certain features of the App. You agree to provide accurate, up-to-date information when creating your account and to keep your account credentials confidential. You are responsible for all activities that occur under your account, and you must notify us immediately of any unauthorized access to or use of your account.
3. Privacy and Data Collection
Your use of the NearU App is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your data in accordance with the Privacy Policy. 4. Location-Based Services
The NearU App may provide location-based services. By using the App, you consent to the collection of location information, including your GPS coordinates or IP address. You can control location sharing through your device settings.
5. Payment and Transactions
The NearU App may offer in-app purchases or paid services. If you make a purchase through the App, you agree to provide accurate payment information and to be charged the applicable fees. All payments will be processed through third-party payment processors, and we are not responsible for any issues related to transactions or payment processing.
a) Refunds
Refunds for in-app purchases are subject to the policies of the third-party payment processor and may not be available for all transactions. Please refer to the payment provider’s terms and conditions for more details.
6. Content and Intellectual Property
a) Ownership
The content and materials available on the NearU App, including but not limited to text, graphics, logos, images, software, and designs, are the property of WEB WORLD or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, distribute, or reproduce any of the content without prior written permission.
b) User-Generated Content
You may be able to submit or upload content to the App, such as reviews, comments, or other materials. By submitting content, you grant us a worldwide, royalty-free, transferable license to use, modify, display, and distribute such content in connection with the App and its services. You represent and warrant that you own or have the necessary rights to the content you submit and that such content does not violate the rights of any third party.
7. Disclaimers and Limitations of Liability
a) Disclaimer of Warranties
The NearU App is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. Your use of the App is at your own risk.
b) Limitation of Liability
To the fullest extent permitted by law, WEB WORLD, its officers, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or in connection with the use of the App shall not exceed the amount you paid, if any, for the App in the last 12 months.
8. Indemnification
You agree to indemnify, defend, and hold harmless WEB WORLD and its affiliates, officers, employees, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the App, your breach of these Terms, or your violation of any rights of another party.
9. Termination
WEB WORLD reserves the right to suspend or terminate your access to the NearU App at any time, without notice, if we believe you have violated these Terms or for any other reason. Upon termination, your right to use the App will cease immediately, and you must uninstall and stop using the App.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.
11. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: The failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
- Entire Agreement: These Terms constitute the entire agreement between you and WEB WORLD regarding the use of the NearU App and supersede all prior or contemporaneous agreements, communications, and understandings.
